Terms of Service

These terms and conditions apply to the use of Penr.ai, a service of Schulten Media. By using Penr.ai, you agree to these terms.

1. Definitions

  • Penr.ai: The SaaS application for AI-driven SEO content automation, a trade name of Schulten Media
  • Schulten Media: The company based in the Netherlands, owner of Penr.ai
  • User: The natural or legal person who has an account with Penr.ai
  • Service: All functionalities offered by Penr.ai
  • Content: Texts, images, and other materials generated through the Service

2. Applicability

These terms apply to all use of Penr.ai and all agreements between Schulten Media and the User. Deviations are only valid if agreed in writing.

3. Account and Registration

3.1 Account Requirements

  • You must be at least 18 years old to create an account
  • You are responsible for the accuracy of your account information
  • You are responsible for the confidentiality of your login credentials
  • One account per person or organization, unless otherwise agreed

3.2 Account Security

You are responsible for all activities that take place under your account. Report unauthorized use immediately to support@penr.ai.

4. Use of the Service

4.1 Permitted Use

You may use Penr.ai for:

  • Generating SEO-optimized content for your own websites
  • Managing and publishing content to connected platforms
  • Analyzing keywords and search performance

4.2 Prohibited Use

It is not permitted to:

  • Use the Service for illegal purposes
  • Generate spam, misleading, or harmful content
  • Reverse engineer or copy the Service
  • Use the Service to overload third-party systems
  • Share login credentials with third parties without permission
  • Use the Service to generate hateful, discriminatory, or otherwise unlawful content

4.3 Content Policy and Moderation

Penr.ai uses automated content moderation to prevent inappropriate content from being generated or published. The following content is strictly prohibited:

  • Sexually explicit material: Pornographic, erotic, or sexually suggestive content
  • Violence and gore: Graphic descriptions of violence, blood, or disturbing imagery
  • Hateful content: Discrimination, hate speech, or content targeting protected groups
  • Illegal activities: Content that promotes or facilitates illegal actions
  • Self-harm: Content that encourages self-harm or suicide
  • Child exploitation: Any material that exploits minors (zero tolerance)
  • Deception: Deepfakes, identity fraud, or deliberately misleading content

Content that does not pass our moderation system is automatically blocked and cannot be saved or published. Repeated attempts to generate prohibited content may lead to suspension or termination of your account.

4.4 Images

The same content rules apply to AI-generated images as to text. Additionally, it is prohibited to:

  • Generate images of real people without their consent
  • Create misleading or fraudulent images
  • Generate images that infringe on copyrights or trademarks

5. AI-Generated Content

5.1 Ownership

Content you generate with Penr.ai is your property. However, you are responsible for reviewing and editing generated content before publishing it.

5.2 Disclaimer

AI-generated content may contain inaccuracies, errors, or unintended content. Schulten Media is not responsible for:

  • The accuracy or completeness of generated content
  • Any infringement of third-party rights through published content
  • Damage resulting from publishing generated content

5.3 Responsibility

As a User, you are fully responsible for all content you publish, including compliance with copyrights, trademarks, and other intellectual property rights.

6. Subscriptions and Payment

6.1 Pricing

  • Prices are exclusive of VAT, unless otherwise stated
  • Prices may be changed with 30 days notice
  • Current prices are listed on our website

6.2 Payment

  • Payment is made in advance, monthly or annually
  • In case of late payment, we may suspend access
  • Refunds are only possible within 14 days of first purchase (cooling-off period)

6.3 Cancellation

  • You can cancel your subscription at any time
  • Upon cancellation, the subscription continues until the end of the paid period
  • After cancellation, your data is retained according to our privacy policy

7. Availability and Maintenance

We aim for 99% uptime but do not guarantee uninterrupted availability. Scheduled maintenance is announced in advance. Schulten Media is not liable for damage caused by interruptions to the Service.

8. Intellectual Property

8.1 Our Rights

All intellectual property rights to the Service, software, designs, and documentation belong to Schulten Media. You only receive a limited right of use.

8.2 Your Content

You retain all rights to content you upload or generate. You grant us a license to process this content for delivering the Service.

9. Privacy and Data

We process personal data in accordance with our Privacy Policy. By using the Service, you agree to this processing.

10. Liability

10.1 Limitation

Schulten Media is not liable for indirect damage, consequential damage, lost profits, or missed savings. Our total liability is limited to the amount you have paid in the 12 months preceding the damage.

10.2 Exceptions

The above limitations do not apply to damage caused by intent or gross negligence by Schulten Media.

11. Changes

We may change these terms. For significant changes, we will inform you at least 30 days in advance by email. Continued use after the change date means acceptance of the new terms.

12. Termination

We may terminate or suspend your account if you:

  • Violate these terms
  • Misuse the Service
  • Fail to meet payment obligations

Upon termination, your right to access the Service expires. Your data is handled according to our privacy policy.

13. Applicable Law and Disputes

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
